What counts as Burglary in Arizona?

Burglary is defined in Arizona Revised Statute 13-1501; Arizona Revised Statute 13-1506,  Burglary in the third degree;   Arizona Revised Statute 13-1507, Burglary in the second degree; and classification 13-1508, Burglary in the first degree.

The definitions are as follows, according to Arizona law:

  • Class 1 Burglary. Remaining unlawfully in a structure (residential or non-residential) or fenced yard with the intent to commit theft or felony while on the property, while knowingly possessing a deadly weapon, dangerous instrument, firearm, or explosives.
  • Class 2 Burglary. Entering or remaining unlawfully in a residential structure with the intent to commit theft or other felonies.
  • Class 3 Burglary. Entering or remaining unlawfully in a non-residential structure or fenced yard or entering into any part of a vehicle through manipulation, with intent to commit theft or felony.

Burglary crimes involving weapons in Arizona can carry more severe punishments. A “structure” is any building, object, vehicle, railroad car, vending machine, or “place with sides and a floor” used for lodging, transportation, storage, business, or recreation.
