Arizona Gun Law Changes Coming

Arizona famously has a lack of regulation around gun laws, and sports some of the most lax gun laws in the United States. For example, according to A.R.S. 13-3112 and A.R.S. 3102, no permit is needed for concealed carrying as long as the individual is above 21 years of age. Additionally, open carrying is allowed with no permit and according to A.R.S. 44-1382, there is no background check required for private gun sales. Currently there are several bills moving through the Arizona legislature that seek to further slacken gun laws, spearheaded by the Republican majority. Time will tell if these bills become law, but at the very least it signals that Arizona will remain a pro-gun state for the time being.

SB 1109 Suppressors

SB 1109 provides that sound suppressors on guns will no longer be considered “prohibited weapons.” Currently, A.R.S. 13-3102 criminalizes the possession of prohibited weapons under the misconduct involving weapons charge. If this bill passes, gun owners can openly use, modify and carry silenced weapons without fear of an MIW charge.

SB 1331 Firearms on School Campuses

SB 1331 is particularly contentious, as it would carve out an exemption in existing law to allow the parents of children in any public college, school, or university to conceal carry, provided they have a state-issued permit to do so. At the moment, under the same A.R.S. 13-2102 statute mentioned previously, it is illegal to, “possess a deadly weapon on school grounds.” SB 1331 would create an exception to this current rule to allow parents to carry on school grounds. Out of all the bills proposed, this one would certainly cause the most controversy if passed due to its sensitive nature.

SB 1428 Gun Shows

SB 1428 concerns the regulation of gun shows around the state. The goal of the bill is to, preempt localities around Arizona from prohibiting the operation of gun shows. Gun shows are an important part of firearm culture, and many of the guns owned in Arizona are displayed and purchased at gun shows. The bill is in response to some local jurisdictions in Arizona passing local ordinances to ban gun shows.
